GROWTH JOURNEY™ APP TERMS AND CONDITIONS AND PRIVACY POLICY Last update: May 23, 2024 TERMS AND CONDITIONS 1. GENERAL The Growth Journey™ App ("App") is provided to you by Star Global Consulting, Inc. ("Star") and Novo Nordisk Pharma Gulf FZ-LLC ("Novo Nordisk") subject to the following terms and conditions. By accepting these terms and conditions on the App, you are agreeing to what is outlined in this document. Please read carefully. 2. CONDITIONS OF USE This App is intended for use solely by people who reside in countries where the App is available for download via Apple and Google app stores and intend to follow the growth of their children. The patient support and treatment plan section of the App is only intended for use by people who have been given an activation code by a healthcare professional. Additionally, the patient support and treatment plan section of the App includes a comprehensive list of clinics and healthcare professionals that are treating growth hormone deficiencies (this might not be available in all abovementioned countries). Those clinics and healthcare professionals are not endorsed by Star. Please choose any clinics and/or healthcare professionals to get treatment at your own discretion. It is your own choice and responsibility to disclose the data to a healthcare professional. To accept these terms and conditions and use the App, (1) you must be 18 years of age or older; (2) you and the children whose data is to be processed, when appropriate, must provide valid consent to the processing of personal health data (see the Privacy Policy below); (3) you must be, and hereby confirm to be, the legal guardian of the child/children whose personal data are being input into the App, and (4) you must have the power to enter a binding contract and not be barred from doing so under any applicable laws. The App is not intended to replace advice or decisions given or made by a healthcare provider. The App provides informational support and is intended to create awareness of the growth of your children. Star and Novo Nordisk are entitled to make changes or updates to the App or remove it from the Apple App Store or Google Play Store at any time. Neither Star nor Novo Nordisk is not responsible for compliance with your Mobile Provider or any charges they may impose related to network connection services while using the App. 3. COPYRIGHT AND LICENSES All content and software used within the App are owned by Novo Nordisk, Star, or by a third party. Use of such third-party software is licensed or granted to Novo Nordisk or Star by the third party. All content and software are protected by copyright. Growth Journey™ is a registered trademark of Novo Nordisk Health Care AG. Distributing, copying, by yourself or by a third party on your behalf, in any circumstances, is prohibited. The App is licensed and not sold. Subject to your compliance with these terms and conditions, you are given a personal, limited, non-assignable, revocable, non-commercial, and non-exclusive license to use the App. This license has the sole purpose of enabling you to use and enjoy the benefit of the App for your personal use, in the manner permitted by these Terms. This license shall remain in effect unless and until terminated by any party. 4. AVAILABILITY AND SYSTEM REQUIREMENTS The App is designed for smartphones that use iOS (Apple) and Android operating systems. The App is available to download for free from the Apple App Store and Google Play Store, only in countries where the app is made available. Therefore, when downloading the App, you may additionally have entered a separate contract with the respective third-party service provider providing your app store, whose terms and conditions may apply. Depending on the respective third-party service provider’s terms and conditions, you may need to exercise your rights of cancellation and revocation, such as regarding App uninstallation, with these service providers. Neither Novo Nordisk nor Star is responsible for the products and services provided by such third parties. You acknowledge that you have read, understood, and agree to the relevant terms and conditions regarding those app stores. Apple or Google are not part of these terms and conditions. Neither Apple nor Google is responsible for the App and its content. A secure internet or mobile network connection is required to download the App to a smartphone and in some cases to access or use certain features and content. Star and Novo Nordisk are not responsible for any issues related to using the app without an internet or mobile network connection. Star and Novo Nordisk are not responsible for the unavailability or malfunctioning of the App and may remove the App from the Apple App Store and Google Play Store at any time. Star and Novo Nordisk are not obligated to provide user support or application maintenance. The App requires at a minimum iOS version 13 or Android version 7 to support its design. The software version requirements may change to support new future designs or developments within the App. Different requirements may then be included in the relevant App Stores. The App does not support native smartphone accessibility settings including but not limited to vision, interaction, hearing, media, and learning. 5. UPDATES Star and Novo Nordisk may update the App at any time, and you are responsible for checking for version updates from the Apple App Store or Google Play Store and downloading such new versions as soon as possible. Your device may offer the option to set automatic updates for applications, in which case the App will automatically download and install updates from time to time without specifically informing you. Star and Novo Nordisk are not responsible for your use of old versions of the App. 6. INFORMATION PURPOSES The App provides selected information on growth in children. Such information is not intended, nor should it be used as medical advice. Such information is not a substitute for the advice of a healthcare professional. If you have any questions regarding your or your child's health, you should consult your general practitioner or other qualified healthcare provider. 7. INFORMATION PROVIDED "AS IS" This App and the information in this App are provided "as is" and Star and Novo Nordisk make no representations or warranties, expressed or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose or non-infringement. Star and Novo Nordisk make no representations or warranties of any kind as to the completeness, accuracy, timeliness, availability, functionality, and compliance with applicable laws. By using this App, you accept the risk that the information may be incomplete or inaccurate or may not meet your needs or requirements. 8. DISCLAIMED LIABILITY Neither Star and Novo Nordisk nor our content providers shall be liable for any damages or injury arising out of your access to, or inability to access, this App or from your reliance on any information provided herein. Star and Novo Nordisk disclaim any and all liability for direct, indirect, incidental, consequential, punitive, and special or other damages, lost opportunities, lost profit or any other loss or damages of any kind. This limitation includes damages or any viruses, which may affect your computer equipment. 9. ALTERATIONS Star and Novo Nordisk reserves its right to alter, modify, substitute, or delete any content of or may restrict access to or discontinue distribution of this App at any time and at their own discretion. Star and Novo Nordisk is entitled to transfer, assign, charge or deal the rights and obligations arising under these terms and conditions to a third party. You will be informed in writing of any transfer of rights and obligations under these terms and conditions; you are then entitled to terminate the contract. 10. COPYRIGHT AND USE OF CONTENT The content of this App is the property of Novo Nordisk and is protected by copyright laws. The trademarks, service marks, trade names, logos and products displayed on this App are protected, and no use of any of these may be made without the prior written consent of Novo Nordisk. You are welcome to download the content of this App, however, only for your personal and non-commercial use. No modification or further reproduction of the contents is permitted. The content may otherwise not be copied or used in any other manner. 11. USE OF QUESTIONS AND COMMENTS Any questions, comments, suggestions or any other communications, including any ideas, inventions, concepts, techniques or know-how you may forward to this App or otherwise to Novo Nordisk or Star, electronically or by any other means, are on a non-confidential basis and will become the property of Novo Nordisk, which Novo Nordisk without restriction may use in any fashion and for any purposes whatsoever including developing, manufacturing and/or marketing goods or services. 12. EFFECTIVE DATE These terms and conditions shall be effective from the date of sign-up. Your registration is deemed accepted once the App is activated. 13. CHANGES TO TERMS OF USE Star and Novo Nordisk will keep these terms including the privacy policy updated. We reserve the right to change these terms at any time. We will inform you of any changes that we make through the App. If you do not agree to these terms and conditions or its revisions, please refrain from using the App. These terms and conditions will apply to any new features, functionality, or updates unless they come with separate or additional terms. No variation, supplement, modification, or amendment of these terms and conditions will be effective unless it is in writing. No conduct, delay, or failure to enforce or exercise rights or remedies under these terms and conditions or by law shall constitute a waiver. No waiver will be effective unless in writing and signed by a duly authorized representative. No provision by the user will supersede these terms and conditions, and any such document relating to these terms and conditions will be for administrative purposes only and will have no legal effect. 14. WHO ARE WE? The company responsible for processing the App’s users and their children’s personal data is: A) Star Global Consulting, Inc. Growth Journey is a growth awareness and patient support App; it is not a diagnostic tool. The App is meant to cater to parents who wish to track their child's growth. If you have any questions or concerns regarding children's growth issues, please consult a healthcare professional. The App enables its users to take a height measurement of their child by placing an image of an adult of a known height next to their child that needs to be measured. When a user takes a picture of the two people correctly, using the user interface feedback in the App as guidance, the image will be uploaded and processed by a machine learning algorithm that infers the height of the child using the adult as a reference. We process (e.g. receive, collect, use, store, and share) relevant personal data from the user directly or indirectly. The user is not required to provide us with their and their child's personal data. However, if they do not provide them, they will not be able to use this App with its entire functionalities. The use of users’ and their children’s information is based on the necessary performance of a contract, in particular, to perform the functionality and provide the content of the App. As the App processes information on children's growth, it processes children's health data based on the users’ (who must be the children’s guardian) consent and, when appropriate, the child’s consent. In that regard, the App will require the child to give consent to the processing of their health-related data when they have reached the age of consent or adulthood defined by local applicable laws. We also rely on our legitimate interest to secure the app and maintain its regular operation. Lastly, we may need to process your information to comply with legal or regulatory obligations. 3. WHAT PERSONAL DATA DO WE PROCESS ABOUT THE USER AND THEIR CHILD For the purpose of processing described above, we may process the following types of personal data: User profile: *E-mail *First name *Last name *IDs *Gender *Weight *Height *Password *Language and time zone *Usage and telemetric data (e.g., date of account creation, date of measurement, feature usage metrics) *Device information (e.g. device type, device version) *Geolocation (country, city, continent) *Unit preference *Notifications and reminders’ schedules *Related child(ren) *Doctors and clinics of choice *Photo Child profile: *First Name *IDs *Date of birth *Gender *Height measures and growth rate *Weight *Height of the child's mother *Height of the child's father *Height of the child (ML measurement) *Activation code for the support and treatment plan section *Health-related data (diagnosis; medication information, such type and brand; dosage type and dose; treatment plan and events; injected body part; treatment schedule) *Notifications and reminders’ schedules *Doctors and clinics of choice *Profile picture *Usage and telemetric data (e.g., date of account creation, date of measurement) *Type of measurement (automatic / manual) *Photo 4. SHARING PERSONAL DATA The user may choose to share the information within the App with a healthcare professional or any other third party. This Privacy Policy does not apply to the use of your information by the healthcare professional. You can ask the healthcare professional about their use of your information. Star shares your personal data with third parties to provide you with the application and to keep operations secure. These third parties must protect the confidentiality and security of your information and only process personal data in accordance with the instructions provided by us, in accordance with this Privacy Policy and signed data processing agreements. App’s data, including personal data, will be saved on the users’ devices, and hosted on servers located in the EU, managed by a cloud provider. We may also disclose other information that is not considered personal data to third parties. In this case, such information will be shared in an aggregated and anonymized form, that does not identify you or any other individuals. Cross-border transfers of data will only take place for the specific purposes mentioned above and in accordance with applicable law. 5. HOW LONG WILL WE KEEP YOUR PERSONAL DATA? We will keep the relevant personal data for as long as necessary to fulfil the purposes described above. We will delete your information when you ask for your account to be removed, or if you withdraw your consent to the processing of your health-related data (what you can do by deleting your account). Children’s personal data will also be deleted if a child, upon reaching consent age or adulthood does not consent to the processing of their personal data. Users can easily stop all collection of information by uninstalling the App. If you uninstall the App, all future collection of information through the App will cease. Please note that if the deletion of the account is not requested, the personal data will still be kept after the App is uninstalled. 6. YOUR RIGHTS Your privacy rights in relation to your and your children’s personal data are listed below. If you are a child above the consent age or that have reached adulthood as set by local applicable laws, these rights are also available to you. You can obtain information on the personal data which we store and processes about you and your child and to the extent you have such right under applicable law, you can get a copy of your and your child's personal data in a structured, commonly used, and machine-readable format. You have the right to rectify personal data that you think is inaccurate and, under certain circumstances, to restrict or object to the processing of personal data. Under certain circumstances, you have the right to have your personal data deleted. You may withdraw your consent to our processing of personal data by deleting your account. Further, if you happen to include the personal data such as images of other adults in the App, you agree and accept that you are the sole responsible for making sure that you explain the App and its functionalities to the relevant adult, to whom you uploaded the personal data to the App, ensuring that they consented their image to be uploaded to the App and processed as indicated under this Privacy Policy. You undertake to hold harmless Star and Novo Nordisk from and against all claims, demands and liabilities in this respect. If you have any questions or want to exercise any of the above rights, please contact Star or Novo Nordisk by using the contact information under the terms and conditions. Under applicable law, there may be limits on these rights depending on the specific circumstances of the processing activity. If you have any complaints about our processing of your and your child's personal data, you may contact the relevant Data Protection Agency in your country.
